Transsexualism, transgenderism and sports under the possibility of eliminating gender as a legal category

The article aims to describe the regulation on the participation of transsexual and intersex athletes in sports contests, from the implications of eliminating the legal category of sex under a human rights-based approach. The international incorporation of equality and non-discrimination has transformed the regulation of sport from a humanistic aspect that seeks to break the old paradigms and go beyond the biological characteristics of the person, thus providing access to multiple identities from an updated construction of the sex and gender. This implies the recognition of transsexuality and transgenderism in international competitions and, therefore, the search for a balance for fair play. Hence, decision-making is based on transdisciplinary and depathologization of bodies, with the debate centered not only on the selection of disciplines, but on elements that include strict vigilance for equality without competitive advantages. This research presents a historical journey between the various methods implemented in order to prove the identities of those who compete, implying in some cases a systematic violation of the human rights of athletes. It is a qualitative analysis with a theoretical methodological orientation that delves into the importance of regulations that consider the concepts of sex and gender as part of high-performance athletes and the need to carry out harmonized regulations, beyond the particular resolutions that may be generated in specific cases.
