The constitutional right to sport in comparative law

The objective of this study is to determine a particular dogmatic of the constitutionally recognized right to sport based on what is stated in comparative law (particularly in academic and jurisprudential doctrine and in the provisions of constitutional norms) in order to contribute to its satisfactory legal regulation in the respective legal systems where it is recognized. Among the fundamental antecedents of the subject appear: Agirreazkuenaga (1998); Gutiérrez and Bermejo (2002). The criteria that are exposed allow to expose the necessary legal effectiveness of a right that, until now, has been the subject of rhetorical glosses rather than legal formulations. The greatest personal satisfaction will be to certify subsequent studies on the "sports world" from the legal point of view, banishing, once and for all, any vestige of misunderstanding and divorce between the two: Law and sport. The study was based on the identification and analysis of the constitutive elements (from the technical-legal perspective) of the right to sport, so that they are the referents for the construction of the particular dogmatics of the law. Theoretically oriented legal research methods were used (theoretical-doctrinal, historical-legal, exegetical and comparative analyzes). The main result obtained was a theoretical foundation for the construction of a particular dogmatic of the constitutional right to sport from the perspective of comparative law.
