Some general aspects about corruption in sport

Abstract

This article aims to expose the current situation of the phenomenon of corruption in sports, and the progressive intervention of Criminal Law in this problem worldwide. It is assumed that in Cuba this topic has not been sufficiently addressed so far, even though it is a contemporary issue widely addressed both from studies on sports law and from research on corruption in a general sense. It then becomes a necessity to look at corruption from sport, and sport from the corruption that is susceptible to occur on it. The works of authors who are referents on the subject, such as: Sánchez (2005); De Vicente (2010); Cortés (2012); Schmitt (2015); Moreno (2016) y Ríos (2017); have been consulted as background. The methods used are strictly of the legal theoretical order, among which the legal historical, the comparative legal and the exegetical one stands out. In this way, the edge of corruption in the right-sport relationship is plotted according to the probability that it will impact any national sports movement, including the Cuban one. The result is a foundation of the convenience of understanding this phenomenon from a broad conception, extending its vision to corrupt acts linked to economic, financial and administrative mechanisms in general as part of the infrastructure of any sports organization, and it was concluded that It is necessary to place this issue as a priority on the agenda of the Cuban sports movement, whose principles and values must be protected at all costs from these harmful practices.
