Governance in sport in Spain. Some practical examples

Abstract

The objective of the article is to describe the legal instruments regulating governance in sport in the Spanish legal system. To this end, on the one hand, the existing normative antecedents on the matter in Spain are analyzed and, on the other hand, the legal framework applicable to this matter at present is exposed. In this way, and from a methodological point of view, the different legislative instruments approved both from the point of view of state public law and by the main sports institutions of the country from the perspective of the private right of self-organization are exposed. After this analysis, a series of conclusions are made. The first conclusion is positive given that there are different legal instruments regulating governance in the country, both from public law and private law. On the other hand, another conclusion lies in the urgent need and convenience of continuing to deepen public regulation to provide an adequate legal framework for the governance of sport in Spain.
